8 . Storage duration; routine deletion or blocking of pd

9 . Rights of the data subject

b) right to rectification

Every person affected by the processing pd has the right to demand the immediate correction of any incorrect pd concerning them. Furthermore, the data subject has the right, subject to the purposes of the processing, to demand the completion of incomplete pd, also by means of a supplementary declaration.

c) right to cancellation (right to be forgotten)

Any person affected by the pd processing has the right to require the controller to immediately delete the pd pertaining to it, if one of the following reasons applies and if processing is not (further) required:

The data subject revokes their consent, on which the processing was based in accordance with Article 6 (1) (a) GDPR or Article 9 (2) (a) GDPR, and there is no other legal basis for processing.

According to Art. 21 (1) GDPR, the data subject submits an objection to the processing and there are no legitimate reasons for the processing, or the person concerned objects to the processing pursuant to Art. 21 (2) GDPR.

The deletion of the pd is necessary to fulfill a legal obligation under the European Union law or the law of the member states, to which the person responsible is subject.

The pd were collected in relation to information society services offered pursuant to Art. 8 (1) GDPR.

d) Right to restriction of processing

Any person affected by the pd processing has the right to require the controller to restrict processing if any of the following conditions apply:

The accuracy of the pd is denied by the data subject, and for a period of time that allows the person responsible to verify the accuracy of the pd.

The processing is unlawful, the data subject refuses to delete the pd and instead requires the restriction of the use of pd.

The person responsible no longer needs the pd for processing purposes, but the data subject needs them to assert, exercise or defend legal claims.

The person concerned has objection to the processing acc. Art. 21 para. 1 DSGVO and it is not yet clear whether the legitimate reasons of the person responsible outweigh those of the data subject.

e) data transferability

Each person affected by the pd processing has the right to receive the pd pertaining to it, which has been provided by the data subject to a responsible person, in a structured, common and machine-readable format. It also has the right to transfer this data to another person in charge without hindrance by the person responsible to whom the pd was provided, provided that the processing is based on the consent pursuant to Art. 6 (1) (a) GDPR or Art. 9 (2) lit. a GDPR or on a contract pursuant to Art. 6 (1) (b) GDPR and the processing is carried out by automated means, unless the processing is necessary for the performance of a task in the public interest or in the exercise of official authority which was transferred to the person responsible.

Furthermore, in exercising their right to data portability under Article 20 (1) of the GDPR, the data subject has the right to obtain that data subjects are transmitted directly from one data controller to another, insofar as this is technically feasible and if this is not the case Rights and freedoms of others are impaired.

f) right to object

Every person affected by the processing pd has the right to object at any time for reasons arising from its particular situation against the processing of pd pertaining to it, which occurs on the basis of Article 6 (1) lit e or f GDPR. 1. Geltung der Liefer- und Zahlungsbedingungen
Diese Bedingungen gelten für die gesamte Geschäftsverbindung mit dem Käufer, auch
wenn bei späteren Geschäften nicht mehr auf sie Bezug genommen wird.

Dieser Auftrag kommt wirksam zustande, wenn wir innerhalb von 14 Tagen nicht
widersprechen. Wir behalten uns vor, den Auftrag schriftlich zu bestätigen. Bestätigen
wir den Auftrag schriftlich, so ist diese Bestätigung für den Inhalt des Liefervertrages
maßgebend. Auch Nebenabreden, Zusicherungen von Eigenschaften und
Vertragsänderungen bedürfen der Schriftform. Mündliche Absprachen mit unseren
Vertretern werden nicht Vertragsinhalt. Vertreter sind nicht ermächtigt,
rechtsverbindliche Absprachen – sei es in Ergänzung oder in Abänderung dieser
Verkaufs- und Lieferbedingungen zu treffen. Sie sind auch nicht berechtigt, Preis- und
Rabattänderungen ohne schriftliche Zustimmung der Geschäftsleitung vorzunehmen
und haben, außer sie sind durch schriftliche Spezialvollmacht ausgewiesen, auch
keine Inkassovollmacht.

3. Lieferung
Als Liefertag gilt der Tag der Abfuhr von uns oder der Tag unserer
Versandbereitschaft. Alle Lieferungen erfolgen ab unserem Sitz in Anif auf Gefahr des
Käufers. Für den Fall, dass nichts anderes vereinbart ist, bleibt die Wahl der
Versandart uns überlassen. Auch für den Fall, dass wir die Transportkosten
übernehmen, bleibt Erfüllungsort und Ort des Gefahrenüberganges Anif. Bei Eingang
der Ware in beschädigtem Zustand ist der Käufer verpflichtet, zur Wahrung des
Rechtes auf Schadenersatz gegenüber der Bundesbahn, Post, dem Spediteur oder
Dritten, eine Tatbestandsaufnahme bzw. Bestätigung durch den Frachtführer zu
verlangen. Schadenersatzansprüche wegen Nichteinhaltung einer vereinbarten
Lieferzeit sind ausgeschlossen, es sei denn, die Nichteinhaltung beruht auf grober
Fahrlässigkeit oder Vorsatz, die uns zuzurechnen sind. Ist eine Lieferzeit vereinbart,
so setzt ihre Einhaltung voraus, dass der Käufer seine Vertragspflichten erfüllt. Der
Liefertermin ist eingehalten, wenn die Ware bis zu seinem Ablauf unser Lager in Anif
verlassen hat oder die Versandbereitschaft mitgeteilt ist. Unvorhergesehene oder
unverschuldete Lieferungshindernisse bei uns oder einem Vorlieferanten berechtigen
uns zum Rücktritt vom Vertrag. Dies, ohne dass dem Käufer dadurch ein
Schadenersatzanspruch entsteht.

4. Preise und Zahlungsbedingungen
a) Unsere Preise verstehen sich in EURO, exklusive Mehrwertsteuer bzw.
Warenumsatzsteuer, exkl. Verpackung ab Werk.
b) Die Bezahlung kann über Kreditkarte, Debitkarte, Nachnahme (nur Österreich) oder
Vorauskasse erfolgen. Im Falle der Vorauskasse senden wir Ihnen eine Rechnung zu.
Unsere Rechnungen sind binnen 30 Tagen ab Rechnungsdatum netto zahlbar. Bei
Bezahlung innerhalb von 14 Tagen ab Rechnungsdatum gewähren wir 2 % Skonto.
c) Wir behalten uns bei neuen Kunden die Lieferung per Nachnahme vor. Zahlungen
tilgen, unabhängig von allfälligen Weisungen, immer die älteste Rechnung. Alle
Zahlungen sind für uns spesenfrei zu leisten. Bank-, Diskont- und Einzugsspesen trägt
der Käufer auch ohne ausdrückliche Vereinbarung.
d) Kommt der Käufer mit fälligen Zahlungen in Verzug, werden uns nach
Vertragsabschluss begründete Zweifel an der Zahlungsfähigkeit oder Kreditwürdigkeit
des Käufers bekannt, so werden alle offenen Forderungen sofort fällig. Bevor die dann
fälligen Forderungen nicht bezahlt sind, sind wir zu Lieferungen aus einem laufenden
Vertrag nicht verpflichtet.
e) Allfällige Zahlungen an unsere Vertreter haben, soweit diese nicht durch schriftliche
Spezialvollmacht ausgewiesen sind, uns gegenüber keine schuldbefreiende Wirkung.
f) Der Käufer darf weder Zahlungen, die nicht auf demselben Vertragsverhältnis
zurückbehalten, noch mit Forderungen aufrechnen, die von uns bestritten und nicht
rechtskräftig festgestellt sind.
g) Wird Ware aus von uns nicht anerkannten Gründen zurückgesandt, so sind wir nach
schriftlicher Nachfristsetzung berechtigt, diese Ware im Selbsthilfeverkauf bestmöglich
zu veräußern. Der beim
Selbsthilfeverkauf erzielte Erlös wird auf dem Konto des Käufers gutgeschrieben und
dieser ist
verpflichtet, den noch offenen Differenzbetrag sofort zu bezahlen.
h) Für den Fall, dass wir aufgrund eines Zahlungsverzuges des Käufers ein
Inkassobüro oder einen Rechtsanwalt mit der Eintreibung der Forderungen
beauftragen, hat der Käufer die tarifmäßigen Kosten zu bezahlen und uns vollkommen
schad- und klaglos zu halten.

5. Eigentumsvorbehalt
a) Die von uns gelieferte Ware bleibt unser Eigentum, bis der Käufer sämtliche
Forderungen bezahlt hat, die wir gegen ihn haben.

6. Gewährleistung und Haftung
a) Erkennbare Mängel sind spätestens innerhalb von 8 Tagen schriftlich unter
Beifügung des
Lieferscheines und/oder der Rechnung zu rügen.
b) Hat unsere Ware Mängel, für die wir haften, so sind wir nur verpflichtet, die Teile,
die nachweisbar infolge eines vor dem Gefahrenübergang liegenden Umstandes
unbrauchbar geworden sind,unentgeltlich nach unserer Wahl bei uns oder beim Käufer
nachzubessern oder auszutauschen. Die mangelhafte Ware ist uns in ihrem
ursprünglichen Zustand zur Überprüfung zurückzusenden.
c) Wir können die Nachbesserung oder Ersatzlieferung verweigern, solange der Käufer
nicht alle, seine nicht mit dem mangelhaften Teil der Ware zusammenhängenden
Verpflichtungen erfüllt hat.
d) Wir behalten uns vor, bei zu Recht bestehenden Beanstandungen statt der
Verbesserung eine Gutschrift über den Warenwert zu leisten.
e) Weitere Ansprüche des Käufers, insbesondere auf Wandelung, Minderung oder
Schadenersatz, sind ausgeschlossen.
f) Wird uns gegenüber ein Mangel gerügt und anerkennen wir die Mängelrüge, so ist
die Übersendung an uns in jedem Falle franko vorzunehmen. Unfrei retournierte Ware
wird nicht angenommen.

7. Erfüllungsort und Gerichtsstand
Die Rechtsbeziehung zwischen dem Käufer und uns unterliegt ausschließlich
österreichischem Recht.
Erfüllungsort für Lieferung und Zahlung ist 5081 Anif. Gerichtsstand für alle
Streitigkeiten aus oder über diesen Auftrag ist die Stadt Salzburg.

8. Rücktrittsrecht
Rücktrittsrecht besteht in Österreich innerhalb 7 Tagen nach Erhalt der Ware, sofern
diese keine Gebrauchsspuren oder Verschmutzungen aufweist. Die Ware ist samt
